Program Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

1.      Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement made between you and United Farm Family Mutual Insurance Company (“we,” “us,” or “our”), concerning your access to and use of our telematics mobile solution, which includes a customized consumer-facing mobile application (“Telematics App”), a consumer-facing dashboard and in-app features (“Dashboard”), associated websites, related social networking sites or pages, and various content, features, downloads, and other materials, products, and services offered or available in connection with our telematics mobile solution (collectively, the “DriveTrend Program”). For purposes of these Terms, the DriveTrend Program may also be referred to as the “Telematics Program.” The DriveTrend Program is supported by Cambridge Mobile Telematics, Inc. (“CMT”). Your participation in the DriveTrend Program is expressly conditioned on your acceptance of these Terms. The DriveTrend Program is completely voluntary. IF YOU DO NOT AGREE WITH ANY PART OF THESE TERMS, DO NOT ACTIVATE THE TELEMATICS APP AND DO NOT PARTICIPATE IN THE DRIVETREND PROGRAM. DOWNLOADING AND ACTIVATING THE TELEMATICS APP CONSTITUTES YOUR ACCEPTANCE OF THESE TERMS.

By accepting these Terms and participating in the DriveTrend Program, you specifically acknowledge and consent to:

·      Continuous background location tracking of your precise GPS location 24/7, including when the app is not actively in use, which will create a comprehensive travel history;

·      Automated driver detection using algorithms that may not always be accurate, and your responsibility to review and correct trip classifications within 14 calendar days;

·      Data sharing with Cambridge Mobile Telematics, Inc. (CMT), technology service providers (including geolocation services), insurance affiliates, and other third parties;

·      Household data sharing, meaning that other enrolled members of your insurance household will be able to view detailed information about your driving activity, including individual trip routes, locations visited, driving events, and performance scores — and you will be able to view the same about them;

·      Algorithmic behavioral monitoring to continuously evaluate your driving and generate proprietary driving scores;

·      Potential future use of your driving data and scores for insurance underwriting, pricing, and risk assessment purposes upon policy renewal with advance notice; and

·      Data retention after you terminate participation, including retention of aggregated or anonymized data beyond our standard data retention period.

These Terms and the Privacy Statement describe the DriveTrend Program in detail, including key aspects acknowledged above. Any new features or tools made available through the DriveTrend Program will also be subject to these Terms.

We reserve the right to update, change, or modify any part of these Terms, or any policy or guideline, or the Telematics App or the DriveTrend Program, at any time for any reason at our sole discretion. We will update the "Last Revised" date at the top of these Terms when changes are made. As a general rule, all changes will be effective immediately upon posting; however, when practicable, we will provide advance notice of changes via email, push notification through the Telematics App, or other reasonable means. In accordance with specific requirements of applicable state insurance laws, some changes may only be made on renewal of your insurance policy and communicated to you in advance. Notwithstanding the foregoing, changes may be implemented immediately without advance notice when necessary to address security vulnerabilities, comply with legal requirements, or prevent fraud or harm; in such cases, we will provide notice as soon as reasonably practicable.

If you do not agree with any changes, you may terminate your participation in the DriveTrend Program at any time by uninstalling the Telematics App. Please note that opt-out of specific features or changes may not be available, and termination of your entire participation may be your only option if you do not agree with modifications. It is your responsibility to check the Telematics App periodically for changes and to maintain current contact information in your account. You waive any right to receive specific advance notice of each change, and your continued use of or participation in the DriveTrend Program after changes are posted constitutes your acceptance of the modified Terms.

These Terms do not change the usage rules set forth in the Apple App Store Terms and Conditions or the Google Play Terms of Service, whichever apply. These Terms may also be viewed on your Dashboard.

2.      About the DriveTrend Program

In connection with the DriveTrend Program, data on driving behavior is collected via the Telematics App and such data is used to calculate a driving score for you. The purpose of the DriveTrend Program is to allow you to gain feedback on your driving performance and reward you for your participation. The Telematics App records and collects driving variables and behavior, as detailed in the Privacy Statement, including but not limited to speed, fast acceleration, hard braking, time of day traveled, vehicle location (GPS), mobile device usage during trips (such as phone handling and whether hands-free features are used), and distance traveled, along with any other data collected through the DriveTrend Program as described in the Privacy Statement (collectively, “Telematics Data”), which is transmitted to CMT and shared with us. It is important to note that the Telematics Data applies to any vehicle operated by you.

Continuous Background Location Tracking

The Telematics App collects precise GPS location data continuously while the app is installed on your device, including when:

·      The app is running in the background;

·      Your device screen is locked or off; and

·      You are not actively using the Telematics App.

You must enable "Always Allow" or "Allow all the time" location permissions for the app to function. This continuous tracking is necessary to automatically detect trips, record driving routes, and analyze your driving behavior. As a result, your location data will reveal:

·      Your home and work addresses;

·      Places you frequently visit;

·      Your daily travel patterns and routines; and

·      Sensitive locations such as medical facilities, legal offices, places of worship, and other private destinations.

By using the DriveTrend Program, you consent to this continuous location monitoring. If you are not comfortable with continuous background location tracking, do not participate in the DriveTrend Program.

Household Data Sharing

The DriveTrend Program includes a household data sharing feature, accessible through the Family Group section of the Dashboard, that allows members of your insurance household to view detailed information about each other's driving activity. If you participate in the DriveTrend Program, other drivers in your household who are also enrolled will be able to see information about your driving for the most recent 14 calendar days, including:

• Your individual trip routes and locations, displayed as map views showing where you drove, including start and end locations;
• Trip details, such as date, time, and distance of each trip;
• Whether you were the driver or passenger on each trip;
• Specific driving events, such as instances of hard braking, speeding, rapid acceleration, or mobile device distractions; and
• Your driving scores, performance metrics, and other comparative data that allows household members to compare their driving behaviors against yours.

You will also be able to view the same information about other enrolled household members.

Who Is in Your Household?

"Household" is determined by the Insurer based on the drivers listed on one or more of your vehicle insurance policies and how those policies or drivers are grouped in the Insurer's system. This typically includes family members and other individuals insured under the same policy or related policies. You do not control who is included in your household for purposes of this feature.

Household Data Sharing Cannot Be Disabled

Household data sharing is a core feature of the DriveTrend Program and cannot be disabled or limited. If you are not comfortable sharing detailed driving information — including your travel routes, locations visited, and driving behaviors — with other members of your household, do not accept these Terms, download the Telematics App, or otherwise participate in the DriveTrend Program.

3.      Operational Notice

The Telematics App uses a certain amount of power from the battery of your mobile device.  Care should be taken to ensure your mobile device is appropriately charged and turned on when driving so that data is properly recorded for the DriveTrend Program.  However, we do not approve of your viewing the Telematics App while driving and it may be a violation of state law.  For your safety, we caution you against distracted driving. The Telematics App may require periodic updates, and you agree that updating the Telematics App from time to time is your responsibility. Once downloaded, the Telematics App must not be deleted or turned off, as the Telematics App will be activated each time you start a trip as either “the driver” or “not the driver” (e.g., as a passenger).

Location services must be enabled at all times and set to “Always Allow” (iOS) or “Allow all the time” (Android) to provide for more accurate data collection.  As described in Section 2, the Telematics App continuously collects precise location data in the background to automatically detect trips, record driving routes, and analyze your driving behavior. This continuous background location tracking may decrease your mobile device’s battery life and/or consume data from your mobile data plan.

YOU UNDERSTAND THAT TEXT AND/OR DATA RATES MAY APPLY FROM YOUR MOBILE SERVICE PROVIDER FOR USE OF THE TELEMATICS APP. CONTINUOUS BACKGROUND LOCATION TRACKING MAY CONSUME SIGNIFICANT MOBILE DATA.

You will have the choice, managed from within the Telematics App or your mobile device settings, to transmit the data collected from a trip through Wi-Fi networks or through cellular networks. You expressly agree that you are solely responsible for any and all text charges, data charges, and other expenses incurred for the use of the Telematics App on your mobile device and/or participation in the DriveTrend Program via your mobile device. 

4.      Registration and Eligibility for the DriveTrend Program

If you wish to register for the DriveTrend Program, you will be required to download and activate the Telematics App on your mobile device with an operating system that is compatible with the Telematics App.  You will also be required to consent to text messages and maintain a data plan at all times for the duration of your participation in the DriveTrend Program.

When you register for the DriveTrend Program, you confirm and agree:

·      To provide us with your full name, a valid email address, and other information that may be requested by us, such as your date of birth.

·      That you own or control a mobile device that is compatible with the Telematics App and that you will have and maintain a data plan at all times.  If your mobile device is not compatible, the Telematics App may not download, download with errors, or fail to perform as intended.

·      That you are the insured person under a vehicle policy for whom we base the policy premium (the “Rated Driver”) or you are another insured person under a vehicle policy (a “Listed Driver”).  Both the Rated Driver and a Listed Driver are eligible to participate in the DriveTrend Program; however, the Participation Discount (as described below) is available only for those vehicle insurance policies associated with the Rated Driver who participates in the DriveTrend Program.

·      To be bound by these Terms.

If you are enrolling a minor (under age 18) in the DriveTrend Program, you represent that you are the minor's parent or legal guardian with authority to consent on the minor's behalf, and you consent to the collection, use, and sharing of the minor's driving data as described in these Terms and the Privacy Statement.

5.      Eligibility for the Participation Discount

When you successfully register for the DriveTrend Program by downloading the Telematics App and completing the registration process, you become a participant in the DriveTrend Program. We offer a premium discount on the vehicle insurance policy associated with the Rated Driver (“Participation Discount”). The Participation Discount does not apply to those policies in which the Rated Driver does not participate in the DriveTrend Program. The Participation Discount is provided for active participation and is not based on your driving score performance.

Important Notice About Future Insurance Use

Currently, your driving score does not affect your insurance premium rates or policy terms beyond the Participation Discount. However, we reserve the right to use your Telematics Data and driving score for insurance underwriting, pricing, and risk assessment purposes in the future. Any such use would be implemented upon policy renewal with advance notice as required by applicable law.

Upon renewal of the vehicle insurance policy, if there has been no confirmed driver trip associated with the Rated Driver within the 60 consecutive days prior to the policy renewal date, the Participation Discount will be removed from the vehicle insurance policy as of the policy renewal date.

6.      DriveTrend Program Feedback

As a participant in the DriveTrend Program, when your Telematics Data becomes available, you can access the Dashboard to view feedback about how you have driven. You will be able to view an overall driving score that considers the Telematics Data. Your driving score is calculated using automated algorithms that continuously monitor and evaluate your driving behavior. The scoring methodology is proprietary and may change over time. All feedback provided is based on your driving as recorded by the Telematics App. 

7.      Activation and Use of the Telematics App

Once downloaded and activated, the Telematics App must be running at all times because the Telematics App will need to detect and record when you start a trip.  The Telematics App uses automated algorithms and sensor data from your mobile device and will be activated each time you start a trip as either “the driver” or “not the driver” (e.g., a passenger). These automated determinations may not always be accurate. The system may incorrectly classify you as "the driver" when you are actually a passenger or classify you as "not the driver" when you are actually driving. Factors such as seating position, phone placement, vehicle type, and driving patterns can affect the accuracy of automated driver detection.

Automated Driver Detection and Your Responsibility

You are responsible for reviewing your trip history and manually correcting any misclassifications. You will be able to manually exclude trips in which you were not "the driver." Any exclusion must be completed within 14 calendar days after the trip, or it will be permanently deemed that you were "the driver." After the 14-calendar day window expires, you will not be able to change the driver classification.

If you do not regularly review and correct trip classifications:

·      Driving behavior of other people may be incorrectly attributed to your driving record;

·      Your driving score may be negatively affected by trips where you were not actually driving;

·      Trips where you were the driver, but the system classified you as a passenger will not be included in your driving score.

By participating in the DriveTrend Program, you acknowledge that:

·      Automated driver detection is not perfect and may contain errors;

·      You are responsible for monitoring your trips and correcting errors within 14 calendar days;

·      Uncorrected trips will be conclusively deemed accurate and included in or excluded from your driving score accordingly; and

·      We do not guarantee the accuracy of automated driver/passenger classification.

8.      Terminating Participation in the DriveTrend Program

You may terminate your participation in the DriveTrend Program at any time by uninstalling the Telematics App, which will prevent further information collections and sharing through the DriveTrend Program.  However, any previously collected Telematics Data will not be automatically deleted upon termination. We will retain your Telematics Data in accordance with our data retention schedule, applicable law and regulation, and as described in the Privacy Statement. Aggregated or anonymized data that cannot be re-identified may be retained beyond our standard data retention period for research, analytics, and business purposes.

If you are the Rated Driver and you terminate your participation in the DriveTrend Program, upon renewal of the vehicle insurance policy, if there has been no confirmed driver trip associated with you (as the Rated Driver) within the 60 consecutive days prior to the policy renewal date, the Participation Discount will be removed from the vehicle insurance policy as of the policy renewal date. 

9.      Privacy Statement

Any Telematics Data or other information collected in association with the DriveTrend Program by us or CMT is subject to the Telematics Privacy Statement (“Privacy Statement”) and by accepting these Terms you agree to be bound by such Privacy Statement. Your Telematics Data will be shared with Cambridge Mobile Telematics, Inc. (CMT), technology service providers (including geolocation services such as Google Maps or similar mapping services), and other parties as detailed in the Privacy Statement.

Please be advised, the DriveTrend Program is hosted in the United States.  In connection with the DriveTrend Program, we do not knowingly accept, request, or solicit information from children under the age of 16. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personally identifiable information in association with the DriveTrend Program without the requisite and verifiable parental consent, we will delete that information from the Telematics App as quickly as is reasonably practicable.

Important Clarification Regarding Claims

Your Telematics Data collected through the DriveTrend Program will not be used by us to adjust or deny any first-party claims you may file under your insurance policy. However, we reserve the right to use your Telematics Data to investigate and adjudicate third-party claims made against you, as well as to assist in legal proceedings, fraud investigations, and crime prevention activities, as more fully described in the Privacy Statement.

10.                 Telematics App License

When you access the DriveTrend Program via the Telematics App, we and CMT grant you a revocable, non-exclusive, non-transferable limited right to install and use one copy of the Telematics App on mobile devices owned or controlled by you, and to access and use the Telematics App on such devices strictly in accordance with the terms and conditions of the Licensed Product End User License Agreement.  You will not: (i) violate any applicable laws, rules, or regulations in connection with your access or use of the Telematics App; (ii) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or CMT on the Telematics App; (iii) use the Telematics App for any revenue generating endeavor, commercial enterprise, or other purpose for which it is not designed or intended; or (iv) use the Telematics App to send automated queries to any website or social networking site or page, or to send any unsolicited commercial email or text messages.

When you use the Telematics App obtained from the Apple App Store or Google Play (each an “App Distributor”) to access the DriveTrend Program, then you acknowledge and agree that: (a) the license granted to you for the Telematics App is limited to a non-transferable license to use one copy of the Telematics App on a device that is supported by an operating system with the usage rules set forth in the applicable App Distributor terms of service; (b) the App Distributor has no obligation to furnish any maintenance and support services with respect to the Telematics App; (c) you will comply with applicable third-party terms of agreement when using the Telematics App; (d) you acknowledge and agree that each App Distributor is a third party beneficiary to these Terms and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof; and (e) in the event of any claim by a third party that the Telematics App infringes upon that third party’s intellectual property rights, we will be solely responsible for the investigation, defense, settlement and discharge of any such claim to the extent required by these Terms.

11.                 User Content

The DriveTrend Program may provide opportunities for you to submit content (“User Content”), such as your name, alias, or profile picture,  or content submitted through any future features or functionality made available via the Telematics App or other means from time to time. If you submit User Content, you represent and warrant that you are the creator of the User Content or have express authorization to submit the User Content.  You further represent and warrant that you will not post, transmit, or distribute via the Telematics App or the DriveTrend Program any of the following: (i) User Content  that will violate or infringe on any copyrights, trademarks, or any other intellectual property rights or other rights of third parties, including the right of publicity or privacy; (ii) User Content that is unlawful, harmful, tortious, threatening, abusive, harassing, hateful, racist, pornographic, obscene, violent, misleading, defamatory, libelous, or invasive of the privacy of another person; (iii) viruses, corrupted data or other harmful, malicious, disruptive, or destructive code; or (iv) User Content that, in our sole judgment, is objectionable or which restricts or inhibits other users from enjoying the DriveTrend Program. We will have the sole and absolute right, but not the obligation, to review, edit, or remove User Content at any time and for any reason. 

You should always use caution when providing any personally identifiable information in any User Content. We do not control or endorse User Content; therefore, we specifically disclaim any liability with regard to User Content.  We or CMT may store User Content for as long as we maintain or support the DriveTrend Program.

12.                 Intellectual Property Rights

Unless otherwise indicated, the Telematics App and the DriveTrend Program are our proprietary property and/or the property of CMT.  All registered and unregistered trademarks, service marks, logos, slogans, designs, and other proprietary information (“Marks”), including, but not limited to text, software, photos, graphics, as well as the entire look and feel of the Telematics App are protected by copyright, trademark, and other intellectual property laws of the United States. You may not copy, imitate, or use the Marks, other than as expressly permitted in these Terms, and nothing in these Terms will be construed as conferring any license to intellectual property rights, whether by estoppel, implication, or otherwise. All other trademarks, service marks, product names, and company names or logos displayed in connection with the DriveTrend Program are the property of their respective owners and may be licensed by us, in which case such license is for our exclusive use or benefit. You may download and print content from the DriveTrend Program as long as you keep intact all copyright, proprietary statements, and trademark notices. No reproduction of any part of the Telematics App or DriveTrend Program may be distributed for commercial gain, nor shall it be sold, modified, or incorporated into any other work or publication. Any violation of these restrictions may result in copyright, trademark, or other intellectual property right infringement that may subject you to civil and/or criminal penalties.

13.                 Interruptions, Inaccuracies, and Termination

We cannot guarantee the DriveTrend Program will be available at all times. Additionally, we may experience problems or maintenance issues related to the Telematics App or other software in connection with the DriveTrend Program, resulting in interruptions, delays, or errors.  We are not responsible if Telematics Data or other data made available through the Telematics App or the DriveTrend Program is not accurate, complete, or current. You agree that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access the Telematics App or any feature of the DriveTrend Program during any downtime or discontinuance of the Telematics App or the DriveTrend Program. Nothing in these Terms will be construed to obligate us to maintain and support the Telematics App or the DriveTrend Program or to supply any corrections, updates, or releases in connection therewith.  We reserve the right to modify or terminate the DriveTrend Program at any time and for any reason.

14.                 Disclaimers

THE TELEMATICS APP AND THE DRIVETREND PROGRAM ARE PROVIDED ON AN “AS-IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND CONCERNING THE DRIVETREND PROGRAM, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THE ABSENCE OF LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OR ABSENCE OF ERRORS, WHETHER OR NOT DISCOVERABLE. THE INFORMATION, SOFTWARE, AND OTHER SERVICES INCLUDED IN OR AVAILABLE THROUGH THE DRIVETREND PROGRAM MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. WE MAY MAKE CHANGES TO THE DRIVETREND PROGRAM AT ANY TIME AND FOR ANY REASON. WE ARE NOT RESPONSIBLE FOR ANY USER CONTENT, YOUR CONDUCT, THIRD-PARTY APPLICATIONS, OR SOFTWARE. WE ASSUME NO RESPONSIBILITY FOR ANY ERROR, OMISSION, INTERRUPTION, DELETION, OR DEFECT IN CONNECTION WITH THE DRIVETREND PROGRAM. WHILE WE ATTEMPT TO MAKE YOUR ACCESS TO AND USE OF THE TELEMATICS APP AND DRIVETREND PROGRAM SAFE, WE CANNOT AND DO NOT REPRESENT OR WARRANT THAT THE TELEMATICS APP OR DRIVETREND PROGRAM ARE FREE OF VIRUSES, MALWARE, DEFECTIVE SOFTWARE, OR OTHER HARMFUL COMPONENTS.  YOU ARE CAUTIONED TO USE THE TELEMATICS APP AND THE DRIVETREND PROGRAM AT YOUR OWN RISK.

WE DO NOT WARRANT AGAINST INTERFERENCE WITH YOUR ENJOYMENT OF YOUR MOBILE DEVICE, INCLUDING THE BATTERY LIFE OF YOUR MOBILE DEVICE.

WE DO NOT REPRESENT OR WARRANT THAT YOUR PARTICIPATION IN THE DRIVETREND PROGRAM OR USE OF THE TELEMATICS APP WILL RESULT IN SAFER DRIVING, PREVENT UNSAFE DRIVING, COLLISIONS, PERSONAL INJURY, DEATH, OR OTHER HARMFUL EVENTS.

THE DRIVETREND PROGRAM IS NOT A SAFETY DEVICE, DRIVER ASSISTANCE SYSTEM, OR COLLISION PREVENTION TOOL. THE TELEMATICS APP AND DRIVING FEEDBACK ARE PROVIDED SOLELY FOR DATA COLLECTION, INSURANCE PARTICIPATION DISCOUNT ELIGIBILITY, AND INFORMATIONAL PURPOSES. YOU REMAIN SOLELY RESPONSIBLE FOR OPERATING YOUR VEHICLE SAFELY, OBEYING ALL TRAFFIC LAWS, AND MAINTAINING AWARENESS OF ROAD CONDITIONS AND HAZARDS. DO NOT RELY ON THE DRIVETREND PROGRAM, DRIVING SCORES, OR FEEDBACK AS A SUBSTITUTE FOR SAFE DRIVING PRACTICES OR YOUR OWN JUDGMENT.

15.                 Limitation of Liability

You agree that these Terms in no way change, modify, or amend the terms and conditions of your insurance policy and any claim for benefits under your insurance policy will be evaluated and adjusted pursuant to its terms and conditions and applicable law. Your participation or non-participation in the DriveTrend Program, and any data collected through the program, does not:

·      Modify, amend, or supersede any term or condition of your insurance policy;

·      Create any new coverage, benefit, or obligation under your insurance policy;

·      Waive any exclusion, limitation, or condition in your insurance policy;

·      Guarantee coverage for any particular claim or loss;

·      Create any right to coverage beyond what is provided in your insurance policy; or

·      Constitute evidence of coverage or a promise to pay any claim.

Your insurance policy is governed solely by the terms and conditions stated in your policy documents, applicable endorsements and declarations pages, state insurance laws and regulations, and general principles of insurance contract law. Nothing in these Terms or the DriveTrend Program modifies your insurance policy.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY DAMAGES OF ANY KIND WHATSOEVER, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OR INABILITY TO USE THE TELEMATICS APP OR THE DRIVETREND PROGRAM, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY YOU ON ANY INFORMATION OBTAINED FROM US OR THAT RESULTED FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OF DATA OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM AN ACT OF GOD, COMMUNICATION FAILURE, THEFT, DESTRUCTION, OR UNAUTHORIZED ACCESS TO THE DRIVETREND PROGRAM. IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE TELEMATICS APP OR THE DRIVETREND PROGRAM OR WITH ANY PROVISION OF THESE TERMS, AS YOUR SOLE AND EXCLUSIVE REMEDY, YOU MAY DISCONTINUE USING THE DRIVETREND PROGRAM.  ALTHOUGH WE WILL NOT BE LIABLE FOR YOUR LOSSES CAUSED BY AN UNAUTHORIZED USE OF THE DRIVETREND PROGRAM, YOU MAY BE LIABLE TO OTHERS, AS WELL AS TO US, IF YOU USE THE DRIVETREND PROGRAM IN VIOLATION OF THESE TERMS.

16.                 Governing Law

These Terms and your use of the DriveTrend Program are governed by and construed in accordance with the laws of the United States and the State of Indiana.  You consent to the exclusive jurisdiction and venue of Marion County, Indiana and waive the defense of forum non conveniens.

17.                 Electronic Communications

By accessing and using the Telematics App or otherwise participating in the DriveTrend Program, you agree that we may collect, use, and disclose certain information about you, your driving behavior, and in some instances other parties, provided to us or CMT. We may use this information to contact you using various electronic communication methods for a variety of purposes, such as to inform you of additional features to the DriveTrend Program or to inform you of any related services (any such contact is a “Message”).  You agree that any Message we may transmit to you electronically will satisfy any legal communication requirements, including that such communications be in writing.  Please be aware that text and/or data rates may apply to Messages you may receive via your mobile device, depending on the data plan you have with your mobile service provider.

18.                 Miscellaneous

These Terms and any policies or statements posted or linked to the Telematics App or with respect to the DriveTrend Program constitute the entire agreement and understanding between you and us.  Our failure to exercise or enforce any right or provision of these Terms will not operate as a waiver of such right or provision. These Terms operate to the fullest extent permissible by law.  We may assign any or all of our rights and obligations to others at any time and for any reason.  If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions. You agree these Terms will not be construed against us by virtue of having drafted them.
